Jim Vines represents seven oil and gas industry associations from Louisiana, Oklahoma, and Texas in challenges to new EPA and NHTSA regulations that would have a devastating effect on the industry. The associations’ briefs, filed in separate lawsuits in the U.S. Court of Appeals for the D.C. Circuit, argue that under the Major Questions Doctrine, utilized most recently by the U.S. Supreme Court in their 2022 decision in West Virginia v. EPA, the agencies lack the “clear authorization” in Congressional legislation required to impose such an impact on the industry, their home states, and the national economy. The Court will hear oral argument in the three cases in the Fall of 2023.
