On March 22, 2024, Sims Funk attorneys Rob Peal and Evan Rothey presented oral arguments before the Tennessee Court of Appeals at Belmont University College of Law. According to Judge Clement, the case was selected for presentation before the law school “based on the interesting issues and the attorneys’ reputation as effective advocates.” The case, 4U2ASKY Entertainment, Inc. v. Blessing Offor, No. M2023-00238-COA-R3-CV, originally arose from a contract dispute between a recording artist and his former management. At issue in the argument before the Court of Appeals was the applicability of the Tennessee Public Participation Act, T.C.A. § 20-17-110 et seq. to the particular facts of this case, among other things. Rob Peal argued on behalf of Mr. Offor and Tim Warnock of Loeb & Loeb LLP argued on behalf of 4U2ASKY Entertainment, Inc..
