  • Obtained full dismissal of purported class action alleging unlawful billing practices and consumer protection act violations on behalf of major health system.
  • Obtained $6,259,826 judgment on behalf of plaintiff risk retention group in dispute related to breaches of fiduciary duty, conversion, and breach of contract by former officers and a third-party vendor.
  • Obtained $677,678.79 verdict in state court jury trial on behalf of managing partner in closely-held partnership related to counterclaims of fraud by omission. Jury determined liability in favor of client with the amount of damages determined by the judge. Original multi-million dollar claims for breach of fiduciary duty against client were dismissed on summary judgment.
  • Represented multi-state hospital system in two-week administrative bench trial against two competing hospital systems and successfully obtained certificate of need to build a freestanding emergency department outside of Memphis, Tennessee.
  • Represented consumer services training organization as defendant in federal jury trial related to multi-million dollar claims of copyright infringement of best practices training manuals.
  • Represented largest dental practice in Middle Tennessee as plaintiff in multi-week federal jury trial related to multi-million dollar claims of First Amendment retaliation against major dental insurance company.
  • Represented nationwide construction company in bench trial related to dissemination of client’s confidential documents to third parties in violation of Court Orders.
  • Represented nationwide manufacturer of agricultural implements and attachments in trademark lawsuit involving nationwide competitor’s use of client’s trademark.
  • Represented multi-national pharmaceutical company in connection with internal and governmental investigations related to allegations of improper sales practices, off-label marketing, and improper involvement in the submission of prior authorizations.
  • Represented nationwide pharmaceutical company in connection with internal and governmental investigations arising out of allegations of improper practices related to the company’s speaker programs.
  • Obtained summary judgment on behalf of law firm related to allegations of legal malpractice by former business client.

Beau’s practice is focused on complex business disputes involving breach of contract, fiduciary duty issues, fraud, unfair competition, and class action claims, as well as trademark and copyright issues. Beau has tried multiple cases to verdict in state, federal, and administrative courts, and he also has experience in arbitrations. Beau has represented businesses and individuals from a variety of industries, including health care, real estate, manufacturing, technology, financial services, consumer products, and pharmaceuticals. He has also represented health care clients nationwide in responding to civil and criminal governmental investigations and defending False Claims Act lawsuits, and he has extensive experience counseling health care clients on Tennessee’s Certificate of Need program.

Beau graduated Order of the Coif from Vanderbilt Law School, where he served as the Honor Council President and a member of the Moot Court Board. He received his undergraduate degree, magna cum laude, from Clemson University. Prior to joining Sims|Funk, Beau was a partner in the Nashville office of a multi-national AmLaw 50 firm.
