After submitting an amicus brief in support of the successful cert petition in the U.S. Supreme Court, Sims|Funk submitted a second amicus brief on the merits in Diamond Alternative Energy, LLC v. EPA, No. 24-7. Counsel for the petitioners indicated that the information added by the Sims|Funk amicus brief likely played a role in the cert grant.  Jim Vines, Sam Funk, Evan Rothey, and Cole Schott drafted the merits stage amicus brief on behalf of several oil and gas trade associations from Texas, Oklahoma, and Louisiana.  These clients join a coalition of states, liquid-fuel producers, and other industry and policy organizations in support of the challenge to what is essentially a nationwide EV mandate generated by the State of California under an EPA authorized exemption to the federal Clean Air Act.  The Court set the case for oral argument on Wednesday, April 23, 2025.
